Better Business Bureau Warns Businesses About Rising Website Privacy Demand Letters

Clearwater, Fla. (June 30, 2026) – A wave of demand letters and lawsuits are currently targeting small businesses, fueled by automated AI bots that are scanning websites to identify tracking tools and auto-generate legal threats. These firms are using the California Invasion of Privacy Act (CIPA)- a decades-old wiretapping law now being applied to modern website tracking- to go after ordinary tools like Google Analytics, the Meta/Facebook pixel, and other ad trackers.

While these legal claims are real, many businesses report receiving demand letters seeking quick financial settlements rather than lengthy court proceedings. Small and medium-sized businesses are particularly vulnerable because they often lack in-house legal or compliance resources to fight back.

Because CIPA allows for statutory damages of $5,000 per violation, these firms use auto-generated templates to threaten massive payouts.  They are betting that these intimidating, mass-produced letters will scare business owners into quick, cheap settlements rather than entering lengthy court proceedings.

BBB encourages businesses to review their websites and work with qualified legal counsel or web professionals to ensure their online practices align with current privacy expectations.

Business owners should consider reviewing the following:
  • Audit Website Tracking Technologies:  Identify exactly which scripts, analytics platforms, advertising pixels, chat widgets, and third-party services are collecting visitor data.
  • Update the Privacy Policy:  Ensure your policy accurately reflects current data collection practices.  Many businesses rely on outdated templates or generated text that no longer match actual site practices.
  • Implement Consent Mechanisms: Consider adding a clear cookie consent banner or other visitor mechanism where appropriate, and review your website's Terms of Use to ensure they match current operations.
BBB reminds businesses that website privacy laws continue to evolve. Even companies that believe they are complying with existing regulations should periodically review their websites, especially after adding new marketing tools or redesigning their online presence.
